Today, the City Planning Commission recommended to the City Council that it grant the Residential Planned Community overlay to permit multi-family development of the existing LaSalle building.

GENERAL MEMBERSHIP MEETING

On April 16, 2012, an Upper Hurstville general membership meeting was held. Approximately 72 of the members attended, as well as members of the public. In addition to the information about the DePaul/ Children's tract and the upcoming block party, there was a spirited discussion about the LaSalle condos. The developer told the attending membership about the history of the project, how and why his plans have developed and changed, and his current plans.

Several members of the group that call themselves the Immediate Neighbors also presented a history of the project, their views and objections to the project, and the reasoning behind their views.

One day before the April 16 meeting, a representative of the Immediate Neighbors requested the Board to add an agenda item requesting a vote on certain aspects of the consensus of opinion regarding the condos. That request is also on dropbox.com/sh/8q41on0wnfezu5r/Vl-MC6tclt .

By a simple majority of those present at the meeting, together with those who sent in written proxies, the following passed:

UHRA is in favor of developing condos within the existing building envelope, but the Association is not in favor of the LaSalle development as drawn.

This letter is coming to you to clear up lots of misinformation about the LaSalle School project that is currently being debated in the City Planning Commission, and City Hall. This is NOT a letter from UHRA, but from 30 families who live immediately next to the building, who have formed their own group in order to represent themselves against a project that has suffered major “project creep” increasing in size 70% from concept to its current plans.

The Position of the Immediate Neighbors of LaSalle School

While our position is very detailed, in essence it boils down to several basic tenets:

· We are for condominium development

· We would like the developer to live within the footprint of the existing building, respecting the historic stature of the building, a concept he has agreed to previously

· We are against a 4^th and/or 5^th floor of the building

· We are concerned about the increased scale of the building, increasing useable square footage by 70%

· We are against the addition of balconies on the historic building

· We are against garages on the site, and are greatly concerned about the parking

We have the following report of an incident in Audubon Park last night:

Last night around 8 p.m., a female jogger was assaulted in Audubon Park near the bridge which connects the golf course and the roadway (roughly where Hurst Street would extend across the park). A male jogger and his dog chased the black male from the area, and the female jogger was unharmed. A neighbor on Exposition Avenue assisted in alerting the police.

It was reported that the perpetrator was a black male, 5’8” 155lb 20 y. o.

UH General Membership meeting

A UH Resident's Association General Membership meeting will be held on Monday, April 16 at 7 pm at Parker Church, 1130 Nashville. All UH members are encouraged to attend.

An agenda is being formulated by the UHRA Board and will be forwarded soon. The meeting will primarily consist of a structured discussion of the LaSalle property development. Mr. MacPhaille, the developer, will be there to update the neighborhood on the project and to answer questions in the first 20 minutes. Another 20 minutes will be allotted to a separate presentation of any objections and concerns with the development. Finally, the last 20 minutes will consist of questions and discussion from any member, likely to be limited to a certain number of minutes per person so that all will get a chance to speak.

LaSalle project update

Many of our neighbors appeared at the City Planning Commission (CPC) to make a public comment concerning the LaSalle condo project. The CPC was considering a change on the zoning to allow multiple families. As already reported, the Resident's Association Board took a neutral position. The CPC will recommend whether or not to recommend the change to the City Council.

The Board of the Resident's Association met last night to discuss the LaSalle project. We have voted to hold a general membership meeting of all the Upper Hurstville residents. The date is to be determined, depending on when we can get the meeting space at Parker on Nashville. We hope to do it the week of April 16.

New plans have been submitted to the CPC, in response to neighbor's concerns and the suggestions of the CPC staff.

THIS IS A MESSAGE FROM THE DEVELOPER, JIM MACPHAILLE:

Hey Karen, Bruce, Jay, Ashley,

I would say that the meeting today could not have gone better.

We had Elliott Perkins and Eleanore Burke from HDLC, Dubravka Gilic, Arlen Brunson, Stephen Kroll, and Leslie Alley from CPC. Hank, William, Justin and I were there to answer and ask them questions. Hank went through a narrative about how everything evolved over the last seven months and put the pictures up of our original submission on the projector screen, laid out all the neighbors concerns, and asked them for their help with our design. I asked them to let us know if they had any issues with the original plan and they spent several minutes with laser lights going over it. We did not want to show them the revisions until we understood what their issues were.

It was interesting, because they really had no problems with the balconies, and Elliott said he liked them but with more mass on the bottom preferably in brick. To our surprise, they had no problem with the wing additions; their concerns were with the roof treatments. They said that they would like to see the shed dormers treated like the rest of the dormers on the building and make them more like hip roofs. They suggested taking the new gable roofs out further and eliminate the corners. They said that in those gables make them look more like the front round windows in that dormer on Perrier and get rid of the fan lights above the square windows. They said they would take the wing additions and tie them into the old additions, get rid of the flat roofs, make way for one continuous roof that would give us actually more square footage, and make the part facing the street a hip roof like the rest of the building. They said on the fourth floor patio they would like to see a parapet system instead of the railings.

We saved our latest concessions until after they completely reviewed the plans from our original submission. After the above discussion, we put the new revised rendering up on the screen. They immediately said that they would love it, and actually said they wanted the balconies on Perrier to be bigger to be in line with the window. They wanted a parapet instead of railings on the 4th floor balcony on the back, and would tweek some other minor things with the roof. They also said that they wanted to move the gate by the garages back to the street as it is inappropriate and they like things squared off. The bottom line is they loved the new plan and will support with some minor changes that Hank and William are already working on.

I hope that the neighbors can see that we listened to their concerns, took them seriously, and have seriously tried to addressed them! As we said back in November, before we bought the property, we don't want a fight, we want your support. I hope the 14 or maybe now 30 neighbors will take a long hard look at this project for what it is, get behind me, and lets get this landmark back in commerce. If you think it is appropriate, please send our latest plans out to the neighbors so they can see for themselves, we have come a long way and their perception is not reality.

At the meeting last Tuesday, the Planning Commission asked that the applicant work with HDLC on revisions to the building. The applicant’s architect, HDLC, and Dubravka and I are going to meet tomorrow to discuss changes that could be made. Presumably, after receiving this input, the applicant will give us revised plans. We will update our staff report to discuss those revisions. The revised staff report will be made available to the Commission and the public for the April 24^th CPC meeting. At that meeting, the CPC should take a vote to recommend that the City Council approve the request subject to provisos or deny it. That recommendation is then forwarded to the City Council, which will have to act on it by June 9.

located in Planning District 3 of the City of New Orleans.

The Future Land Use Map currently designates the Calhoun Campus as "Institutional
Land Use" with a proposed Comprehensive Zoning Ordinance categorization as "Medical Campus". Children's Hospital believes Institutional Land Use is the most appropriate land use designation for the Calhoun Campus.The Institutional Land Use designation permits....[Institutional designation allows] Children's Hospital to develop additional hospital facilities and emergency health care services and infrastructure which is a stated policy of the Plan. It also permits Children's Hospital to expand mental health services for children which the Plan recognizes as a significant unmet need ... Ochsner Baptist, Touro Infirmary, and the Henry Clay Campus are all located in the uptown region and all have an institutional land use designation .

It would substantially reduce the economic value of the property and arguably constitutes a taking of property without compensation. Children's Hospital has already invested tens of millions of dollars in acquiring and improving this property. These investments will be greatly devalued and the opportunity to invest millions more into the property will be lost if the land use designation is changed and Children's is forced to seek conditional use permits... .

... However, we do not believe that neighborhood desires to prevent future expansion of the health care facilities and uses are legitimate concerns. Furthermore, such desires to prevent future health care development of this property are contrary to the stated goals and policies of the adopted Master Plan and are not in the best interest of the majority of the residents of New Orleans. ...The personal desires of a handful of residents should not override the very real needs of the majority of the residents of Greater New Orleans.

The UH Residential Association has taken the position that a medical facility like Ochsner Baptist, Touro Infirmary, and the Children's Henry Clay Campus would be an inappropriate use of the DePaul campus on the edge of Audubon Park.

NOCCA update/another daytime carjacking nearby/ reminder of new traffic cameras uptown

LaSalle School/NOCCA Project Status Update:

The UH Zoning Committee has been working with the developer, Jim MacPhaille, on the development of the LaSalle School/NOCCA property. In December Mr. MacPhaille presented general schematics to the UH Zoning Committee to convert this property into luxury condos. As the property is currently zoned RD-2 (Two Family Residential) a zoning change to Multi-Family would be required for this conversion. At that time, the committee agreed that the neighborhood supported the concept of 12-13 luxury condos on the site with the understanding that more detailed plans would need to be presented to the neighborhood in order to obtain final support for the project. Since that time the developer has submitted plans to the City Planning Commission in order to request a zoning change. A public hearing is scheduled for March 27 at 1:30 PM in the City Council Chamber in City Hall.

The UH Residence Association has submitted a request to Mr. MacPhaille for clarification on the plans. In addition, approximately 15 immediate neighbors to the LaSalle School/NOCCA property met informally on Sunday (3/11) to discuss the current status of this project. The primary concerns of this group were as follows.

The plans presented had numerous design inconsistencies (elevations not matching, units not clearly defined...)
The plans have significant lack of detail (building/fencing materials not indicated, kitchens/bathrooms not indicated, exterior lighting not indicated...)
Expansion of the building is extensive (addition of 4th floor, exterior balconies)
The number of curb cuts greatly reduces street parking on Webster and Perrier Street
Proposed use of the basement as first floor apartments and "hotel suite"
Insufficient visitor parking provided
Reduction in green space leading to potential drainage issues

At the conclusion of this meeting it was recommended that the UH Zoning committee reconvene in order to

Review the current plans incorporating the neighborhood's comments

Develop response to plans
Request Mr. MacPhaille withdraw the plans as submitted in order to address the concerns of the neighborhood prior to a city hearing

While the immediate neighborhood continues to support the concept of 12-13 luxury condos on this site, additional information would need to be provided/reviewed in order to provide full support of the project. GIST: Victim parked his vehicle in his driveway, as he exited the perpetrator approached from behind. The perpetrator pointed a black semi-automatic handgun at the victim and demanded his wallet. The victim refused; the perpetrator then requested the victim’s car keys, the victim began to yell. Neighbors began to appear causing the perpetrator to flee. The subject fled on foot north on Octavia to Magnolia then turned west (left) toward Tulane University to unknown.

Starting March 12, the following uptown locations will have traffic cameras:

Eastbound Camp Street at International School of Louisiana
Eastbound and westbound Freret Street at former Audubon Primary Academy site (the building that now houses Company Burger, Freret Street Yoga and Anytime Fitness)
Northbound and southbound Jackson Avenue at Sci Tech Academy
Westbound Annunciation Street and Second Street at Clay Square Park
Northbound and southbound Carrollton Avenue at KIPP Believe School
Eastbound and westbound Prytania Street at Louise McGehee School

Other changes include:
1. The threshold for issuance of speed safety camera citations on all streets during non-school zone hours and outside a school zone will be ten miles per hour or greater over the posted speed limit. The citation threshold will remain 6 miles per hour over the speed limit during school zone hours when the lights are flashing.
2. The speed limit on Jackson Avenue is low and will be raised to 35 miles per hour.
3. A change school zone will extend zone times from 90 minutes to 2 hours of a school's start and end times. The change, including new signage, will start prior to the start of the 2012-13 school year.
4. A new appeals process.

Upper Hurstville has added another patrol car to our area from 6:30 pm
until 2:30a. This NOPP (N.O. Private Patrol) car is in addition to our NOPD
detail patrol, and it is shared with our neighboring association, Audubon
Area. The extra patrol started Wednesday, February 15. This will continue
through Mardi Gras day to give us extra protection and additional escort
capability. It is an expense for which we budgeted in our annual budget.

Please do not hesitate to use the escort service and to give the patrol
number to your guests and visiting family members. If you have not yet
added the patrol number to your cell phone for quick access, please do
so.

Also, you may want to add the patrol number as one of the first responders
on your alarm company's emergency call list. Our patrol can reach your
home faster than the NOPD.

NOCCA UPDATE

The developer of the NOCCA Webster and Perrier site has provided this
2/1/12 message to update everyone on his progress:

We are starting to remove all the vines and trees out of the brick facade
on the school and then they will pressure wash the building as they go.
The city is finalizing their plan review process on our two houses which
should end tomorrow. Upon that completed review, we are told, they will
issue the two permits. We will immediately start construction beginning
with the foundations which I am happy to say, because of our design, will
not require any pile driving. The houses should take 7 months to construct.
During this time we will also be awaiting our PUD or conditional use for
our reduced density plan for the 12 condos in the school building, with a
handicap unit on the first floor. We have received our demo permit on the
caretakers house but will be using it as a temporary office for our
contractor. At the appropriate time we will then be donating it to the PRC
deconstruction department.

We have Ranger Environmental collecting the ballasts for all the florescent
lights as well as 8 x 8 floor tiles to be disposed of properly in a
state-approved dump with a state-approved transportation company. The
gutting is underway using the water misting process discussed and trash
shoots to the dumpster to eliminate most of the dust. It appears to be
working and we are committed to making as little impact on the neighbors as
humanly possible during this construction process. If anyone has any
questions, concerns, or complaints, please tell them to email me or call if
they are not the emailing type. I appreciate the call about the oak tree.
The oak tree has been roped off to protect the roots so that equipment
can't go near the tree and compact the roots. We have gone through great
lengths and expense to design a house around the tree and as Bruce said we
don't want a costly mistake by a contractor to kill our tree. We have a
tree expert from the Audubon Institute coming out to consult on the pruning
and fertilizing of the two large oaks and I have introduced myself to the
neighbors to discuss our trimming plans.

We have a scrap iron company taking out the boiler, iron sprinkler pipes
and radiators, all to be recycled. Also it appears that the thieves did not
get all the cooper so we are recycling that as well. In about a month, the
gutting will be complete and we will be working on the new roof system
which requires re-decking and framing. We will be tearing off the single
story brick addition on the Webster side which currently houses the
bathrooms. Once we get our approval (hopefully at the April meeting) we
will rebuild as per the plans we showed you. We are still waiting for the
Sewage and Water board to come out and fix the leak in front of the
building and the plumber assures me that it is on the City side. I will
know for sure when my first bill comes. Entergy came out and removed the
overhead lines crossing Perrier to the school and we will be moving the
lines from the front of the building to the Webster side and going
underground. Their engineering department has been called and we hope that
they won't have to cut off anyone's power when they get to work on the new
transformers. A neighbor called and asked about getting the storm drains
cleaned out as they are full of mud since the storm. We have been calling
since we bought the building and the contractor said today he would dig
them out himself.

This is a big project so I appreciate everyone's patience and support. But
I wanted to mention that I had a neighbor ask me why we are "taking so
long." I told her respectfully that I didn't think we were! I said that we
are on the agenda for sometime in April, it's just around the corner,
hopefully we will be heard, and then can really get moving on the school
building. But please tell your members, I don't control the docket, the
city does, they are busy, and I am sure everyone wants us to get started
asap. I think everyone knows that the building has been sitting for ten
years but I just closed in November. We realize it is an important project
to the neighborhood but they need to understand that once approved, it will
probably take two years to complete. I can only reassure the neighbors that
I am eager to start on the school asap, it costs me money everyday it sits,
but I know that once complete, everyone will be happy with the results.

The City Planning Commission voted yes to Upper Hurstville's request to
keep the Covenant Home's current land use designation as it is, keeping the
Magazine Street side as " small neighborhood commercial" and the Camp
Street side "low density residential".

It must now be approved by the City Council. We will let you know the date

Upper Hurstville has been in touch with Mr. MacPhaille regarding the large live oak at the corner of Webster and Coliseum Streets on the LaSalle School construction site. Some neighbors have observed heavy construction equipment rolling over the roots of the tree. Mr. MacPhaille has already instructed the workers to avoid the tree and will fence it off. He has every interest in protecting that tree.

CPC hearing/ crimes in area/asbestos abatement/ sexual offender

City Planning Commission

On January 10, the City Planning Commission held additional hearings on the DePaul site and Covenent home potential zoning changes. The CPC staff made recommendations consistent with our neighborhood's requests. Many of our neighbors and many of the members of our UH Zoning Committee appeared and spoke at the public hearings on these matters for the second time. Audubon Area and Audubon Riverside also spoke in support of the UH requests.

Rapes uptown

Last week, the 9th of January at 2:45 a.m. in the 6000 block of S. Robertson St. The victims were two white females both of them from out of town and staying with relatives in the area.

They both had been in the French Quarter celebrating for the BCS Football Game. They got into a cab in the downtown area for a ride to the relatives house. At some point they had an disagreement with the cab driver and he kicked both out of the cab.

As they were walking and approached the the intersection of S. Robertson and Palmer St. they were approached by the perpetrator an unknown black male. He grabbed one of the victims and implied that he had a gun and would harm them if the didn't comply. They complied with his instructions.

The perpetrator forced them into an dark alley in the 6000 block on S. Robertson St. The perpetrator them proceeded to rape the two victims.

At some point during the incident one of victims was able to determine that the perpetrator didn't have a weapon as he had implied. The two victims were able to escaped from the perpetrator and run from the alley and they were able to get help from a nearby residence.

The perpetrator was described as: Black Male, Dark Complexion, approximately 5' 4" Tall, approximately 120 to 130 lbs. wearing a White T-Shirt and Dark Colored Pants.

Asbestos Abatement Contractors has begun to seal off the asbestos areas and started air testing. You will see monitoring equipment and men in special suits, respirators, and special bags. Copper Theft from LaSalle/Nocca

Professional copper thieves had recently stripped the building of all its electrical wiring and copper pipes between December 23rd and January 1. They used ladders, bolt cutters, and battery operated tools to cut out and take down the water pipes, some gutters, the wiring, and even pulled out window a/cs to get the copper out of those units too. They dragged it through the building and out the front door on Perrier. They would have had to park a van or truck and loaded it by hand.

Mr. MacPhaille asks that anyone who may have witnessed anything unusual at the site in that time period to please call NOPD.

DePaul and Covenant/Extra patrols start tonight/Good reason to use patrols/update on Walgreens

ZONING AND CITY PANNING COMMISSION MEETING

Many of our UH Zoning Committee members, as well as other interested neighbors, attended the City Planning Committee meeting in City Hall on December 13. (see upperhurstville.com for previous emails for an explanation of our positions on zoning for the DePaul and Covenant sites).

Our Zoning Committee's organization, under the leadership of Bruce Worley, was superb. Board member and Zoning Committee member Jay Seastrunk presented an effective visual demonstration of the problems that would result from the inappropriate zoning of the DePaul site. Many others spoke as well, and the good turnout from UH was very helpful in convincing the Commission and our political representives that we are watching this very closely. Many thanks to Bruce and Jay for their tireless efforts in passing out papers flyers to the neighborhood just before the meeting, as well as organizing the support of our neighboring resident's associations.

We also thank Jane Apffel and Mary Looney for staying for the entire four hour meeting (that is dedication!) and especially to Jane for speaking to the Commission on the Covenant matter.

Our Zoning Committee volunteers are working hard to preserve the qualities of our area.

The second hearing on the 2011 Master Plan amendments will occur January 10th at 6pm in the City Council Chamber. If anyone would like to speak on how the Master Plan will affect our neighborhood, please plan to attend.

Tonight I called the patrol for an escort from the car to the house around 8pm. Glad I did. There is plenty of traffic on Henry Clay, but halfway through the car-to-house-with-two-kids-and-shopping-bags process a dark colored Crown Victoria type vehicle flies onto Benjamin and stops where we're standing. Two young adult male occupants with windows down check us out, see the patrol man there with us and screech up Benjamin and right onto Webster. Something was just not right. _______

UPTOWN MESSENGER ACCOUNT OF REPORT ON WALGREENS TO UPTOWN RIVERSIDE NEIGHBORHOOD ASSOC.

The meeting has just begun and the first speaker will be Peter Aamodt of Stirling Properties, the developer of the proposed Walgreens that will go in the redeveloped American Legion hall on Magazine Street.
